Terms of use

Who we are

FormulaIT LLC (“FormulaIT”, “we”, “us”) is a limited liability company registered in Wyoming, United States. These terms cover formulaitai.com and the websites, web apps and mobile apps we publish. A product may have additional terms, which apply alongside these.

Your account

You must be at least 13 years old, or the minimum age required where you live, to use our products. Keep your sign-in details secure and tell us at support@formulaitai.com if you think someone else has used your account. You are responsible for activity on your account.

Subscriptions and payments

• Prices, credits and what each plan includes are shown in the product before you buy.
• Subscriptions renew automatically at the end of each billing period until you cancel. You can cancel at any time and keep access until the end of the period you paid for.
• Purchases on our websites are processed by our payment providers. Purchases in our iPhone apps are processed by Apple under the App Store's terms, and Apple handles their billing, cancellations and refunds.
• We may change prices for future billing periods. We will tell you before a change affects you.

Your content and AI results

You keep ownership of the content you add to our products. You give us permission to store, process and transmit it only as needed to run the product for you, including sending it to our AI model providers. You confirm you have the rights to the content you upload.

Results produced by AI can be inaccurate or unexpected. Review them before relying on them, and you are responsible for how you use them.

Acceptable use

Do not use our products to:

• Break the law or infringe anyone's intellectual property, privacy or other rights.
• Upload content that is unlawful, harmful, sexually exploitative, or that you do not have permission to use.
• Interfere with, overload, reverse engineer or gain unauthorised access to our systems.
• Resell or share access to the product without our written permission.

We may suspend or close accounts that break these rules.

Our intellectual property

Our products, software, designs and brand names belong to FormulaIT LLC. We give you a personal, non-exclusive, non-transferable licence to use them under these terms. Nothing else is transferred to you.

Apps from the App Store

If you downloaded one of our apps from Apple's App Store, these points also apply:

• These terms are between you and FormulaIT LLC only, not Apple. We, not Apple, are responsible for the app and its content.
• Your licence is limited to using the app on Apple-branded devices you own or control, as allowed by the Usage Rules in the App Store Terms of Service.
• Apple has no obligation to provide maintenance or support for the app.
• If the app fails to meet an applicable warranty, you may notify Apple and Apple will refund the purchase price, if any. To the extent the law allows, Apple has no other warranty obligation for the app.
• Apple is not responsible for any claims relating to the app, including product liability claims, claims that it fails to meet legal or regulatory requirements, and consumer protection or privacy claims. We are responsible for investigating and handling any claim that the app infringes a third party's intellectual property.
• You confirm you are not located in a country subject to a U.S. government embargo and are not on a U.S. government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

Disclaimers

We work hard to keep our products reliable, but they are provided “as is” and “as available”. To the extent the law allows, we disclaim all warranties, including fitness for a particular purpose and non-infringement, and we do not promise the products will be uninterrupted or error-free.

Limitation of liability

To the extent the law allows, FormulaIT LLC is not liable for indirect, incidental, special or consequential damages, or for lost profits, data or goodwill. Our total liability for any claim relating to our products is limited to the amount you paid us in the 12 months before the claim, or US$100 if you have not paid us. Nothing in these terms limits rights you have under consumer law that cannot be waived.

Ending these terms

You can stop using our products and delete your account at any time. We may suspend or end your access if you break these terms or if we stop offering a product, and where we can we will give you notice and a chance to export your content.

Governing law

These terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict of law rules. If you live in a country whose consumer laws give you the right to bring claims in your local courts, these terms do not take that right away.

Changes to these terms

We may update these terms. We will post the new version here and revise the date at the top, and tell you in advance about significant changes. Continuing to use our products after a change means you accept it.
